Question by Kimoko: My 19 year old son is a heroine addict while I’m still paying child support NJ?
My 19 year old son is a heroine addict while I’m still paying child support . I don’t have custody of my child, but i pay child support for him to begin community college. Obviously, he can’t continue school under his conditions. So does anyone know if there is a way for me to legally stop paying child support in order to have money to help my child get into a good rehab center. The amount of child support i’m paying prohibits me from fully supporting my son. Is there anyway i can bring his heroine addiction to court for a reason to stop paying child support.I live in NJ.
Please refrain from complaining about the child support cutoff being at age eighteen in your state. It is simply not the same case in NJ.
I was never married to the mother of my son, so there were no divorce decree’s to look upon.
My son needs help which he can find at a rehabilitation center, and he’s wasting time ” going to college.” ( he’s only attended twice.)

Why are you paying child support on an adult to begin with? In Texas the cutoff is 18. NJ is a hellhole!

    I’d go back and check your original divorce decree. Child support typically ends when the child turns 18 or graduates high school – whichever is later. Normally you only have to pay child support beyond this cutoff if the child has a disability.

    If you’re paying child support for a child who has turned 18, check the court order setting support to see if it contains a provision to terminate support once your child turns 18. If it doesn’t contain this language, you’ll need to ask your child’s other parent if he or she will agree that your child is now emancipated and no longer requires support. If the other parent won’t agree, you’ll have to head to court and ask a judge to emancipate your child and terminate your support obligation.

    Pull out your divorce decree and see what it states.

    But, him being an heroine addict, and getting rehab, maybe a problem. He would need to WANT help, and not forced, then even after rehab, back to square one and addicted.

    No there isn’t, I hope you and his mother can put aside the animosity long enough to get him some help.
    Child support is tied to about half his total cost, his share so to speak of rent, utilities clothing.
    You may have made arrangements about paying for his college, which is a different thing.
    It can’t be used for other purposes.
