I have legal custody of my grandson since May of 2004 in which time her mother went to drug rehab see saw him 4 months after she got out in Oct 2004. From then til now has been in numerous drug rehabs and prison. She has not seen my grandson since Oct 2004. Are there any legal actions I can take.

I’m a little confused–if you already have legal custody, what’s the issue? I think there’s more to this that we need to know to answer correctly.

neither drug rehab nor prison count as ‘abandonment’ because they are things the mother had to do and couldn’t take a child with her. It would only be abandonment if she entered rehab without first ensuring the child was safely in your custody.
However, if she has a serious drug problem she can still have her parental rights revoked due to that drug problem. The process for this varies from state to state. If you wanted to know about the process contact child services for your individual state.
An action as extreme as severing parental responsibilities can cause plenty of drama in the family. Why don’t you speak to your daughter and see if she will agree to allow you to adopt the child. This would still make you the parent in almost the same manner as severing your daughters parental rights, but it’s easier, cheaper, and less likely to cause difficulty between you and your daughter.
